Last June, the sentence in favour of the Citizen Observatory protecting the Ecological Preservation area of El Charco del Ingenio was ratified by the Guanajuato Administrative Court of Justice. This means that within the 392 hectares included in the municipal protected area, both authorities and developers must punctually respect the territorial integrity and land uses established in the Municipal Urban Development Program (PMDUOET). Pursuant to the program, the housing developments included in the El Charco buffer zone are not authorized to have or offer lots smaller than 1,000 m2, nor to build homes over 4 m in height. This mandate includes the Garambullos and Obraje developments. So any permission in this regard by the municipal authority is illegal and can be challenged in Court.
