Last June, the sentence in favor of the Citizen Observatory that protects the El Charco del Ingenio Ecological Preservation area was ratified by the Administrative Court of Justice of Guanajuato. This means that within the 392 hectares included in the municipal protected area, both authorities and developers must promptly respect the territorial integrity and land uses established in the Municipal Urban Development Program (PMDUOET). According to the program, the housing developments included in the El Charco buffer zone are not authorized to have or offer lots smaller than 1,000 m2, nor to build houses over 4 m high. This mandate includes the Garambullos and Obraje developments. Therefore, any permission from the municipal authority in this regard is illegal and can be challenged in court.
